These Terms and Conditions ("Terms") govern your use of the enoikio website, software, and services (collectively, the "Platform"), operated by Soho Technologies Ltd ("we," "us," or "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use our Services.
3.1. To use the Services, you must register for an account. You agree to provide accurate, current, and complete information.
3.2. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account.
3.3. We reserve the right to suspend or terminate accounts that we suspect of fraudulent activity or violation of these Terms.
You acknowledge and agree that enoikio acts solely as a Technical Service Provider (TSP). We provide the software interface to facilitate property management and data transmission.
If you use the Platform as an Agent or Property Manager, you warrant that you hold all necessary legal authority and Power of Attorney to enter into lease agreements and initiate payment collections on behalf of the property owner (Beneficial Owner).
Subscription fees are billed monthly in advance.
Fees are deducted automatically from the payout amount or billed separately, depending on the Payment Processor's configuration.
In the event of a failed Direct Debit (e.g., insufficient funds), you acknowledge that:
6.1. By entering their IBAN and accepting a Mandate request, the Tenant authorizes enoikio to transmit instructions to the Landlord's Payment Processor to debit the Tenant's account.
6.2. The Tenant acknowledges that this electronic mandate carries the same legal weight as a paper mandate.
6.3. Variable Amounts: The Tenant acknowledges that the Direct Debit amount may vary (e.g., for rent adjustments or building charges). The Landlord agrees to provide the Tenant with advance notice of any variable charge via the Platform as per SEPA regulations (Pre-Notification).
7.1. Our "Affordability Score" and "Identity Verification" services utilize Open Banking APIs provided by regulated partners.
7.2. Tenant Consent: These services are only activated upon the explicit consent of the Tenant. The Tenant may revoke access to their banking data at any time via their banking app.
7.3. No Guarantee: The Risk Score is an informational tool based on historical data. We do not guarantee the future payment performance of any tenant. The Landlord remains solely responsible for the final decision to lease a property.
Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You agree not to use the Platform for:
10.1. To the maximum extent permitted by law, enoikio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
10.2. Our total liability for any claim arising out of these Terms or the Services is limited to the amount you paid us to use the Services in the 12 months preceding the claim.
10.3. We are not liable for delays or failures in payment processing caused by banking systems, clearing houses, or third-party Payment Processors.
11.1. You may terminate your account at any time by contacting support.
11.2. We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
